These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to this website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to Terms
We may update these Terms and Conditions from time to time. Continued use of the website indicates acceptance of any updated terms.

Photography Service Terms and Conditions

1. Definitions

  • Photographer: The commissioned photographer whose details are set out under Photographer Information.

  • Client: The party commissioning the photographer, including parents/legal guardians if under 18, affiliates, assignees, and successors.

  • Subject: The primary individual/object being photographed, including appearance, likeness, form, or voice (e.g., person, animal, landscape, building).

  • Property: Real or personal property including animals, pets, objects, or buildings.

  • Material: All creative photographic or moving image material produced during the session, including negatives, RAW files, prints, digital files, or other media.

  • Shoot: The photographic session commissioned by the client.

  • Working Days: Any day other than Saturday, Sunday, or public holidays in England and Wales.

  • Working Hours: 9 a.m. to 5 p.m. on a working day.

  • Minor: Any individual under 18 years old.

  • Model: The subject being photographed.

  • Estimate: A document outlining the fee, expenses, and usage licenses.

  • Fee: The photographer’s fee as set out in the Estimate.

2. Terms Overview
These terms contain the entire agreement between the photographer and the client and supersede any prior agreements. Amendments must be in writing and agreed by all parties.

3. Session Agreement
The photographer will provide services in accordance with the chosen shoot and industry standards. Creative choices made by the photographer are deemed acceptable.

4. Estimates
Estimates are based on information provided by the client. Any changes before or during the shoot may increase fees. Payment of the deposit constitutes acceptance of the Estimate.

5. Exclusivity and Conduct
The shoot date, time, and location are agreed upon mutually. The shoot is not confirmed until the deposit is paid. No cameras are permitted except the photographer’s equipment. Client requests must be submitted at least three working days in advance. The photographer is not responsible for client, subject, or associated party behaviour.

6. Coverage and Creative Privilege
The client accepts the photographer’s creative choices, including editing and retouching. Coverage is determined by the photographer’s professional judgment.

7. Cancellation

  • Photographer cancellations due to unforeseen circumstances (weather, illness, etc.) will result in rescheduling at no extra charge or full refund if cancelled.

  • Client cancellations made at least ten working days in advance may reschedule with no additional charge. Cancellations within ten working days result in forfeited deposit.

8. Proofing and Ordering
Material will be presented within 30 days of the shoot. Final images may be edited or discarded at the photographer’s discretion. Printing errors after client approval result in the client covering 50% of the original cost plus reprint costs. All sales are final; print colour may fade over time.

9. Pricing
Prices may change without prior notice. Deposit receipt confirms shoot price.

10. Deposit and Payments
A 30% non-refundable deposit is required at booking. Remaining fees, including travel and materials, must be paid 10 working days before the shoot. Late payments will incur 2% daily charge to cover administrative costs and business disruption.

11. Travel and Accommodation
Travel within 100 miles round trip from PO21 is included. Beyond 100 miles, 45p per mile applies. Accommodation may be required for distances over 100 miles. Client covers these costs.

12. Storage of Material
Material is archived for a reasonable period. After six months, the photographer is not liable for loss or quality degradation. Clients must store material securely and may not share without written permission.

13. Copyright
Copyright remains with the photographer (All Rights Reserved). Clients receive usage rights only after full payment. Unauthorized use incurs additional charges.

14. Usage Rights and Credits
Material may only be used per the agreed usage license. Client must not alter, edit, or enter material into competitions without written permission.

15. Model Release
Client and subject grant the photographer the irrevocable right to use material in any media for editorial, advertising, marketing, or promotional purposes (excluding pornographic or defamatory use).

16. Property Release
Client grants the photographer irrevocable rights to use material depicting property for editorial, advertising, marketing, or promotional purposes.

17. Liability
Client indemnifies the photographer against claims, costs, or legal actions arising from unauthorised material use or breach of these terms. Photographer is not liable for indirect or consequential losses. Maximum liability is limited to the total fees paid for the shoot. Liability for death, personal injury, or fraud is not limited.

18. Governing Law
These terms are governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of the courts of England and Wales.
